WALLESS Assisted a Client in a Precendential Case on the Regulation Of In-House Agreements

WALLESS public procurement experts Laura Ziferman and Marius Dobilas represented a client in the precedential administrative case regarding the regulation of in-house agreements.

The Supreme Administrative Court of Lithuania has changed its long-lasting case-law and followed the position of the Supreme Court of Lithuania that all conditions for in-house agreements shall be directly stipulated in the Law on Public Procurement. Therefore, other legal acts and particularly general provisions of competition law should not be taken into account when assessing the legality of the in-house agreement.
