carVertical win: database sui generis rights cannot block the reuse of public data for innovative products
Another big step toward legal clarity for digital businesses and data-driven innovation! The Lithuanian Court of Appeal ruled in favour of carVertical in a dispute with autoplius.lt, confirming that using publicly accessible data is not a violation unless the database owner can prove a risk to the possibility of redeeming investment through the normal operation of the database.
The court pointed out that the two businesses operate in different markets – one focuses on selling advertising space, the other on providing vehicle history reports to buyers. Different focus, no proven harm – and no unfair competition.
