Kaisa Üksik comments on the parties’ rights when products are sold by an unauthorised reseller
Kaisa Üksik, Head of Competition Law Practice Group at WALLESS in Estonia, explains the sales and competition rules in relation to the allegations made by the Piaggio Group, a prominent Italian motorcycle manufacturer, against an Estonian reseller with whom cooperation was terminated.
If a supplier (manufacturer) opts to use resellers for product distribution, competition rules allow the supplier to impose resale restrictions in certain cases. This can be done through exclusive or selective distribution systems, which provides more control over product sales. However, these restrictions do not fully protect the supplier from parallel trade, which is rooted in the principle of free movement of goods.
