In the case concerning the prohibition of taking a skills test for a private pilot’s license, the Senate has referred questions to the Court of Justice of the European Union.

The Senate’s decision of 12 December 2024 in case No. SKA-28/2024 has referred preliminary questions to the Court of Justice of the European Union and suspended proceedings in the administrative case. The case concerns a dispute over the Civil Aviation Agency’s one-year prohibition imposed on the applicant from retaking the skills test required to obtain a private pilot’s license.

To determine whether the prohibition on the applicant retaking the skills test for a private pilot’s license is appropriate and in line with the objectives of European Union law, the interpretation of the EU legal provisions applied in the case will be examined.
