Extradition of EU citizens to the United States: Kaie Proode and co-authors analyse the challenges of the principle of proportionality of punishment – the example of Estonia (European Journal of Crime, Criminal Law and Criminal Justice)
In the European Journal of Crime, Criminal Law and Criminal Justice, WALLESS Junior Associate and Junior Lecturer of EU Criminal Law at the University of Tartu Kaie Proode, together with Anneli Soo (Associate Professor of Criminal Law, University of Tartu) and Paloma Krõõt Tupay (Associate Professor of Constitutional Law, University of Tartu), examines the application of the principle of proportionality of punishment in the extradition of EU citizens to the US.
The analysis highlights that the features of the US sanctions system may pose a risk of disproportionate punishment by Estonian standards. It also shows that EU Member States have different approaches to extradition, with the protection of fundamental rights depending on bilateral agreements and their implementation.
