WALLESS secures revocation of representation rights in two general partnership disputes
The WALLESS dispute resolution team has successfully represented clients in two separate court proceedings concerning the restriction of general partnership members’ representation rights. Both cases were grounded in a provision of the Commercial Law of Latvia which allows a court to revoke a member’s right of representation upon the claim of another member, where significant reasons exist.
In the first case, the Riga Regional Court granted an interim protection following request submitted on behalf of a WALLESS client – one of the members of a general partnership. The court revoked the respondent’s right of representation and granted the WALLESS client exclusive authority to represent the partnership individually. Following the ruling, the Register of Enterprises of the Republic of Latvia updated the official records, removing the respondent’s representation rights and registering the WALLESS client as the sole authorized representative.
In the second case, the Supreme Court of Latvia upheld a favourable Latgale Regional Court decision for another WALLESS client, also a member of a general partnership. The client sought partial revocation of the other members’ representation rights. The Supreme Court dismissed the cassation appeal and confirmed that, under the Commercial Law, a member’s representation rights may be partially revoked where justified.
